AGREEMENT TO OUR LEGAL TERMS

We are ImageToMotion Studio ("Company," "we," "us," "our"). We operate the website https://imagetomotions.com and the ImageToMotion Studio SaaS web application (the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and ImageToMotion Studio, concerning your access to and use of the Services. By accessing the Services, you confirm that you have read, understood, and agree to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.

USER CONTENT AND RESPONSIBILITIES

By uploading any image, reference video, or other content ("User Content") to ImageToMotion Studio, you represent and warrant that:

  • you own all rights (including copyright) in the User Content, or you have obtained all necessary licenses, permissions, and releases to upload, process, and generate AI motion videos or images from that content;
  • your User Content does not infringe, misappropriate, or violate the intellectual property, privacy, or publicity rights of any third party;
  • you will not upload content that is illegal, obscene, defamatory, harassing, or that contains child sexual abuse material (CSAM) or any other prohibited content;
  • you will not use the generated output for any fraudulent, deceptive, or otherwise unlawful purpose.

You retain full ownership of your original User Content. We do not claim any ownership over your User Content or the generated AI output, but you are solely responsible for how you use the output.

COPYRIGHT INFRINGEMENT & DMCA POLICY

ImageToMotion Studio respects the intellectual property rights of others. If you believe that any content available on or through our Service infringes a copyright you own or control, please immediately notify our designated copyright agent by email at imagetomotionteam@gmail.com.

Your notice must comply with the Digital Millennium Copyright Act (DMCA) and include:

  • Identification of the copyrighted work claimed to have been infringed;
  • Identification of the material that is claimed to be infringing (including a URL or description);
  • Your contact information (name, address, email, phone);
  • A statement that you have a good faith belief that the use is not authorised;
  • A statement under penalty of perjury that the information is accurate and you are the rights owner or authorised to act;
  • Your physical or electronic signature.

We will respond to valid DMCA notices within a reasonable time and may remove or disable access to the allegedly infringing content. If you believe your content was removed by mistake, you may submit a counter-notice to the same email address.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, ImageToMotion Studio and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising from: (i) your use or inability to use the Service; (ii) any unauthorised access to or alteration of your User Content; (iii) any claims that your User Content or generated output infringes third-party rights; (iv) the quality, accuracy, or availability of AI-generated motion videos or images. Our total liability shall not exceed the amount you paid us (if any) in the 12 months prior to the claim.

GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of France. Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through informal negotiations for 30 days. If unresolved, the dispute shall be submitted to binding arbitration in Nancy, France, in the English language.
